3. General principles

3.1 Which data do we collect from you, and from whom do we receive it?

We primarily process personal data that you provide to us or that we collect when operating our website. In some circumstances, we also receive personal data about you from third parties. This may include the following categories:

  • Personal master data (name, address, date of birth, etc.);
  • Contact details (mobile phone number, email address, etc.);
  • Financial data (e.g. bank account details);
  • Online identifiers (e.g. cookie identifiers, IP addresses);
  • Location and traffic data;
  • Audio and image recordings;
  • Sensitive personal data (e.g. biometric data or information about your health).

3.2 Under what conditions do we process your data?

We treat your data confidentially and in accordance with the purposes set out in this privacy policy. We ensure that processing is transparent and proportionate.

If, exceptionally, we are unable to follow these principles, data processing may nevertheless be lawful because a justification exists. Such justifications may include:

  • Your consent;
  • Performance of a contract or pre-contractual measures;
  • Our legitimate interests, provided that your interests do not outweigh them.

3.3 How can you withdraw your consent?

If you have given us consent to process your personal data for specific purposes, we process your data within the scope of that consent unless we have another justification.

You can withdraw your consent at any time by sending an email to the address specified in the legal notice. This does not affect processing that has already taken place.

3.4 When may we disclose your data to third parties?

a. General principle

We may need to use the services of third parties or affiliated companies and engage them to process your data (so-called processors). Recipient categories include:

  • Accounting, fiduciary and auditing companies;
  • Consulting firms (legal advice, tax, etc.);
  • IT service providers (web hosting, support, cloud services, website design, etc.);
  • Payment service providers;
  • Providers of tracking, conversion and advertising services.

We ensure that these third parties and our affiliated companies comply with data protection requirements and treat your personal data confidentially.

In some circumstances, we may also be obliged to disclose your personal data to public authorities.

b. Visiting our social media channels

Our website may contain links to our social media channels. These are identifiable to you, typically by the corresponding icons. Clicking an icon takes you to our social media channels.

In this case, the social media providers learn that you are accessing their platform from our website. They may use the data collected in this way for their own purposes. Please note that we have no knowledge of the content of the data transmitted or how the operators use it.

c. Disclosure abroad

In some circumstances, processing by service providers may involve transferring your personal data to companies abroad. These companies are subject to the same data protection obligations as we are. Transfers may take place worldwide.

If the level of data protection does not correspond to that in Switzerland, we carry out a prior risk assessment and ensure contractually that equivalent protection is guaranteed, for example through the European Commission’s new standard contractual clauses or other measures required by law. If our risk assessment is negative, we take additional technical measures to protect your data. The European Commission’s standard contractual clauses are available at: https://commission.europa.eu/publications/standard-contractual-clauses-controllers-and-processors-eueea_de

3.5 How long do we retain your data?

We store personal data only for as long as necessary to fulfil the individual purposes for which it was collected.

Data stored when you visit our website is retained for twelve months. Analysis and tracking data may be retained for longer.

We retain contractual data for longer because legal requirements oblige us to do so. In particular, we must retain business correspondence, concluded contracts and accounting records for up to ten years. If we no longer need this data to provide services, it is blocked and used only for accounting and tax purposes.

3.6 How do we protect your data?

We store your data securely and take all reasonable measures to protect it against loss, access, misuse or alteration.

Our contractual partners and employees who have access to your data are required to comply with data protection provisions. In some cases, we may need to forward your enquiries to affiliated companies. Your data will also be treated confidentially in these cases.

On our website, we use SSL (Secure Socket Layer) together with the highest level of encryption supported by your browser.

3.7 What rights do you have?

a. Right of access

You can request information about the data we hold about you at any time. Please send your access request together with proof of identity to philipp@nobel.swiss.

You also have the right to receive your data in a commonly used file format if we process your data automatically and:

  • You have consented to the processing of this data; or
  • You have provided data in connection with entering into or performing a contract.

We may restrict or refuse access or the release of data if it conflicts with our legal obligations, our own legitimate interests, public interests or the interests of a third party.

Your request is subject to the statutory processing period of 30 days. We may extend this period due to a high volume of requests, for legal or technical reasons, or because we need further information from you. You will be informed of an extension in good time, at least in text form.

b. Erasure and rectification

You can request the erasure or rectification of your data at any time. We may reject the request if legal provisions require us to retain data for longer or without alteration, or if another lawful basis prevents us from complying.

Please note that exercising your rights may conflict with contractual agreements and may affect performance of the contract, for example through early termination or resulting costs.

c. Legal remedies

If you are affected by the processing of personal data, you have the right to enforce your rights in court or file a report with the competent supervisory authority. In Switzerland, the competent authority is the Federal Data Protection and Information Commissioner: https://www.edoeb.admin.ch

3.8 Changes to this privacy policy

We may amend this privacy policy at any time. Changes will be published at https://nobel.swiss; you will not be notified separately.

4. Individual data processing operations

4.1 Providing the website and creating log files

What information do we receive, and how do we use it?

When you visit https://nobel.swiss, certain data is stored automatically on our servers or the servers of services and products that we use and/or have installed, for system administration, statistical, security or tracking purposes. This includes:

  • The name of your internet service provider;
  • Your IP address, where applicable;
  • The version of your browser software;
  • The operating system of the computer used to access the URL;
  • The date and time of access;
  • The website from which you visit the URL;
  • The search terms you used to find the URL.

Why are we permitted to process this data?

This data cannot be attributed to a specific person and is not combined with other data sources. Log files are stored to ensure that the website functions and to safeguard the security of our information technology systems. This constitutes our legitimate interest.

How can you prevent data collection?

Data is stored only for as long as necessary to achieve the purpose for which it was collected. Accordingly, it is deleted after each session ends. Storing log files is essential for operating the website, so you cannot object to this.

4.2 Google Analytics

We use Google Analytics on our website, a web analytics service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). Google Analytics uses cookies — text files stored on your computer — to analyse your use of the website.

The information generated by the cookie about your use of this website is generally transmitted to a Google server in the USA and stored there. If IP anonymisation is enabled on this website, Google first truncates your IP address within EU member states or other states party to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and truncated there.

On behalf of the website operator, Google uses this information to evaluate your use of the website, compile reports on website activity and provide other services relating to website and internet usage.

The IP address transmitted by your browser as part of Google Analytics is not combined with other Google data.

You can prevent cookies from being stored by adjusting your browser settings. However, you may then be unable to use all website functions fully. You can also prevent Google from collecting and processing the data generated by the cookie relating to your website usage, including your IP address, by downloading and installing the browser plugin available at: https://tools.google.com/dlpage/gaoptout.

4.3 Google Tag Manager

To manage website tags through a single interface, we use Google Tag Manager, a service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). Google Tag Manager itself, which implements the tags, is a cookie-free domain and does not process personal data. The service triggers other tags that may collect data. Google Tag Manager does not access this data. If tracking has been disabled at domain or cookie level, this remains effective for all tracking tags implemented through Google Tag Manager.

Using Google Tag Manager may automatically activate scripts, known as tags, on our website and transmit data from your browser to Google. This data may include your IP address, browser, the pages visited on our website and other interactions during your visit.

4.4 Sendgrid

Our website uses Sendgrid, a product of Twilio Inc., to optimise and send email communications. Sendgrid helps us ensure that our emails are delivered reliably and allows us to analyse user behaviour in relation to those emails.

When you contact us, subscribe to a newsletter or receive other forms of email communication from us, your email address and, where applicable, other personal data such as your name or preferences are stored and transmitted to Sendgrid for processing. This data is used to send you the requested information and monitor the effectiveness of our communications.

Sendgrid uses technologies such as cookies or tracking pixels to detect whether emails have been opened and which links have been clicked. This enables detailed analysis of the effectiveness of our email campaigns and our users’ interests.

You can withdraw your consent to the processing of your data and unsubscribe from our newsletter at any time. Each email we send contains an unsubscribe link.

4.5 Font Awesome

Font Awesome is operated by Fonticons, Inc., based at 6 Porter Road, Apartment 3R, Cambridge, MA 02140, USA. It is a collection of scalable vector icons that enables website developers to incorporate icons and social logos into their websites.

We use Font Awesome to display visual icons on our website. These may include interface icons, social media links or other graphics that enhance the design and user experience.

Font Awesome may load web fonts from Fonticons, Inc. servers when you visit our website. Your IP address is transmitted to Fonticons, Inc. so that your browser can display the icons correctly.

Fonticons, Inc. stores users’ IP addresses only briefly and solely to provide the Font Awesome icons. No further storage or analysis takes place.

4.6 Google Fonts API

We use the Google Fonts API on our website, a service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”), to incorporate fonts. When you visit our website, your browser connects to Google’s servers to download and display these fonts correctly.

This connection may transmit data, particularly your IP address and browser information, to Google and store it on Google servers. These servers may be located in the USA or other countries.

If you wish to prevent data transmission through the Google Fonts API, you can block access to fonts.googleapis.com in your browser settings. Please note that our website may then not display correctly.

4.7 WordPress

Our website is based on WordPress, a content management system developed by Automattic Inc., 60 29th Street #343, San Francisco, CA 94110, USA. WordPress enables us to create, manage and publish content.

When you use our WordPress-based website, various data may be collected and stored, including your IP address, the date and time of access and information about your browser. This data is used primarily for administrative purposes and to ensure smooth website operation.

Some WordPress functions, such as comments or contact forms, may collect additional personal data when you use them.

4.8 CookieYes

Our website uses CookieYes, a consent management and privacy compliance service provided by CookieYes Limited. CookieYes helps us obtain and manage user consent for cookies and online tracking in accordance with legal requirements.
When you visit our website, CookieYes may collect information about your consent choices and interactions with the consent popup. This information is used to ensure that only cookies and tracking technologies you have approved are enabled on your device.

4.9 Google reCaptcha

To protect the online form on our website against unwanted requests, we use reCAPTCHA, a service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). The check distinguishes human input from abusive automated processing. Information such as your IP address or your behaviour while completing the form may be transmitted to Google.

For this purpose, your input is transmitted to Google and processed there. By using reCAPTCHA, you agree that your recognition work contributes to the digitisation of older works. If IP anonymisation is enabled on this website, Google first truncates your IP address within EU member states or other states party to the Agreement on the European Economic Area.

Only in exceptional cases is the full IP address transmitted to a Google server in the USA and truncated there. On behalf of the website operator, Google uses this information to evaluate your use of this service. The IP address transmitted by your browser as part of reCAPTCHA is not combined with other Google data.

4.10 Google Analytics

You can also prevent Google from collecting and processing the data generated by the cookie relating to your website usage, including your IP address, by downloading and installing the browser plugin at https://tools.google.com/dlpage/gaoptout.
